LIMITED WARRANTY

All Engineered Stiles, Engineered Rails, Veneers, Grilles, Core Material, herein referred to as products, and any other product manufactured by or supplied by FOREMOST WOOD PRODUCTS of Staten Island, New York, herein referred to as FOREMOST, (except those products expressly excluded from this warranty by FOREMOST) are warranted by FOREMOST for 30 days from receipt of shipment, to be of good material and workmanship and to be free of defects which would render said product unserviceable or unfit for the ordinary, recommended use. This warranty is made solely to the original purchaser.

If at the time a shipment is received, said products are found to have a defect(s) which can reasonably be discovered by inspection of each item, the receiver of the product(s) must, prior to hanging, fitting, gluing and machining, and within 5 days of delivery, send written notice of said discovered defect(s) to FOREMOST. Any claims for shortage must be made within 5 days of delivery. If a defect is discovered or occurs after the product is processed, written notice of said defect(s) must be sent to FOREMOST within 30 days from date of shipment. No claim will be honored unless a field inspection is performed or another arrangement is negotiated by or with an authorized representative of FOREMOST.

If warranted products are found to contain defects as stated herein, FOREMOST at our option will either, furnish purchaser with replacement product(s) or refund to the original purchaser the amount the originally paid to FOREMOST for the returned defective item(s). FOREMOST shall not be liable under any circumstances for any loss, damage or expense directly or indirectly arising from the use of the products sold hereunder or from any other clause, and FOREMOST shall not be liable for consequential or incidental damages. This warranty does not cover any other charges incurred such as labor, transportation to and from destination or reimbursement for any other work not originally performed by FOREMOST. At no time shall the claim exceed the amount of the individual items in question nor will FOREMOST accept ANY back charges whatsoever unless previously authorized by FOREMOST.

LIMITATIONS AND EXCLUSIONS
1. Natural variations in the color or texture of wood are not to be considered as defects.
2. Veneer thickness tolerance shall be +/- .015".
3. Warp shall not be considered a defect in stiles and rails unless it exceeds 1/8 inch in any 7 foot section within the plane of the stile or rail itself.
Warp is any distortion in the stile or rail itself and does not refer to the relationship of the stile or rail to the door which it has become an intrigal part of or jamb in which it is hung. The term "warp" shall include bow, cup and twist. Measuring the amount of warp in a stile or rail, the following method shall be used: bow, cup or twist shall be measured by placing a straightedge on the suspected concave face of the stile or rail at any angle (i.e., horizontally, vertically, diagonally). The measurement of bow, cup and twist shall be made at the point of maximum distance between the bottom of the straightedge and the face of the stile or rail.
4. Foremost will not be liable for delay or failure to deliver caused by acts of GOD, strikes or any other causes beyond its control, or the premium transportation charges for alleged lateness in making shipment when such lateness is caused by the foregoing, or shipment is made within the current lead times plus three (3) days. All due dates and lead times refer to the projected ship date or time required for ordered items to ship from our plant. These dates do not include shipping time which can vary by destination. At no time shall it be assumed that FOREMOST will cover premium transportation charges unless previously authorized by FOREMOST.
5. All the following products are excluded from this warranty
A. All engineered stiles or rails less than 3-1/2" wide.
B. All engineered stiles or rails less than 5" wide with only one edge.
C. Any engineered stile or rail with face veneers of different species.
D. Any stiles used in an exterior environment which are manufactured of Poplar or other material not suitable for exterior applications.
E. Delamitation and or warpage on engineered stiles used in an exterior environment with veneers less then 1/4" thick and or where the product is not properly prepared and sealed for an exterior application.
F. Delamitation and or warpage on any engineered rail used in an exterior environment.
G. Any product which failure can be contributed in whole or in part to manufacturing flaws of the purchaser or their agents.
H. Any engineered stile or rail manufactured without one or both face veneers.
I. Any engineered stiles or rails used on doors in which construction of one side of the door differs from the construction of the other or any final product which is unbalanced.
J. Any product FOREMOST deems structurally unstable - this will be noted in writing by FOREMOST.
6. Foremost shall not be liable for any damages caused by improper handling by the buyer or its representatives.
7. Any implied warranty shall be limited in duration to the period of this warranty.
8. FOREMOST shall not be liable for any damages without the prior consent of FOREMOST.

HANDLING INSTRUCTIONS
1. Upon receipt of shipment of product, inspect each item for any visible defects. Product should not be left in shipping container, but should be stored on a flat and level surface in a dry, well ventilated building. Cover to keep clean and keep out of sunlight, but allow air circulation.
2. Product should not be subject to: abnormal heat, extreme dryness, humid conditions or sudden changes therein. They should be conditioned to average prevailing relative humidity of the locality before handling or further processing.
3. The utility or structural strength of the product must not be impaired in the machining, the application of the hardware, or cutting and altering for lights, louvers, panels or any other special details.
4. Before finishing, remove handling marks or effects of exposure to moisture with a thorough final sanding over all surfaces of the product using 150 grit sandpaper. Clean before applying sealer or finish. Some species of wood contain a chemical (oak particularly) which reacts unfavorably with certain finishes. Where possible, the surface should be tested for such unfavorable reactions. Application of a sealer before finishing will usually prevent this difficulty. Do not use steel wool on oak.

CLAIMS
Product shipped by common carrier ceases to be our property when the carrier's agent hands us his formal receipt acknowledging that he has received the material in good condition. Any claims for missing or damaged material become the responsibility of the carrier from the time it leaves our plant until it arrives and is accepted at the destination. FOREMOST will assist the customer in processing claims to the carrier as a service to our customer. It is mandatory that the agent of the purchaser sign copies of the delivery tickets and note any discrepancies or damages at the time of receipt so that the claim can be properly filed, Failure to note damage on the bill of lading at receipt of merchandise may make collection of damages impossible.

There are no warranties that extend beyond the foregoing, and FOREMOST's responsibility under this warranty is as stated herein. FOREMOST shall not be liable for consequential, incidental damages, or for any amount in excess of the original price paid for the individual items in question, whether the claim is for breach of warranty or negligence.
